The website available at the following address: www.magni-ops.com (hereinafter referred to as the “Site”) is the property of SOLUTIONS AÉRIENNES MAGNI-OPS INC, whose head office is located at 426 Richelieu Street – J4X1G8 Brossard, registered in the business register under number NEQ 1181127144 (hereinafter “MAGNI Ops”), which offers a comprehensive range of drone surveillance services and, in its capacity as the controller of personal data, attaches great importance to the protection and respect of privacy.

This privacy policy aims to inform individuals browsing the Website (hereinafter referred to as “Users” or “User”) of MAGNI Ops' practices regarding the conditions under which it collects, uses, and shares the information that Users provide, as well as their rights. The Website complies with French and European standards relating to the protection of privacy and personal data, in particular Law No. 78-17 of January 6, 1978, known as the “Data Protection Act,” relating to data processing, files, and freedoms, amended by Law 2004-801 of August 6, 2004, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, known as the “GDPR,” relating to the protection of individuals with regard to the processing of personal data and the free movement of such data.

1. Person in charge of processing the personal data collected

The person in charge of processing personal data is primarily MAGNI Ops.

2. Nature of the data collected

The data collected in connection with the use of the Site is data that enables MAGNI Ops to identify Users directly or indirectly. This may include the following categories of data concerning its Users:

  • Civil status, identity, and identification data such as name or company name, first name, pseudonym, email address, postal address, date of birth, landline and/or mobile phone number, profession, professional sector of activity, and social media account URL;
  • Connection data such as IP address and browsing data such as cookies.

Users who communicate the personal data of a third party must confirm that they have obtained the consent of that third party for the use by the Site, publication and/or dissemination on the Site of the latter's personal data.

3. Purpose of personal data collection

3.1 Personal data collected on the Site is used only for and during the performance of services

To send notifications to the User to:

  • Ensure the provision of MAGNI Ops services.
  • Keep Users informed about news in its sector of activity.
  • Send targeted content to the User, corresponding to their needs.
  • Communicate with the User.

In addition, MAGNI Ops may use the data to fulfill its legal and/or regulatory obligations, where applicable.

3.2 MAGNI reserves the right to publish, disclose, and use aggregated information (information relating to Users or specific groups or categories of Users combined in such a way that an individual User can no longer be identified or mentioned) and non-personal information for industry and market analysis, demographic profiling, promotional and advertising purposes, and other commercial purposes.

4. Time of collection

The data collected by MAGNI Ops is freely provided by Users and collected automatically when using the Website, when the User sends a request to MAGNI Ops by email and/or via the dedicated “Contact Us” call-to-action button on the Website and purchases MAGNI Ops' services.

In any event, the personal data collected:

  • will be obtained and processed fairly and lawfully;
  • will be recorded for specific and legitimate purposes;
  • will be used in accordance with those purposes;
  • will be adequate, relevant, and not excessive in relation to those purposes; and
  • will be subject to precautions to ensure the security and confidentiality of the data to prevent it from being damaged, altered, destroyed, or disclosed to unauthorized third parties.

5. Consent

This privacy policy is systematically brought to the attention of Users when they visit the Site. Indeed, visiting the Site implies the User's express, full, and complete acceptance of this privacy policy.

By checking the box: “I acknowledge that I have read and understood the privacy policy and I accept it,” the User consents to their personal data being stored and processed by MAGNI Ops and/or its potential partners.

Furthermore, where required by law and/or in certain circumstances, the User's consent will be obtained or an option to refuse will be provided before any data is transmitted.

6. Recipients of personal data

6.1. The recipient of personal data collected on the Website is primarily MAGNI Ops.

6.2. Personal data is not disclosed to third parties. However, other recipients may have access to personal data. These may include service providers responsible for the Website (administration, sales, marketing, legal, etc.) of MAGNI Ops and its external service providers (technical, access and product service providers, communication agencies, etc.).

6.3. In the event of a change of control of MAGNI Ops due to a merger, acquisition, bankruptcy proceedings, or any other form of asset transfer, the data collected by MAGNI Ops may be transferred to third parties. However, MAGNI Ops undertakes to guarantee the confidentiality of the personal data collected and to inform Users before such data is transferred or subject to new confidentiality rules. Where required by law, the User's consent will be obtained or an option to refuse will be provided before any data is transferred.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, known as the “GDPR” on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Law No. 78-17 of January 6, 1978, known as the “Data Protection Act,” amended by Law 2004-801 of August 6, 2004, on information technology, files, and civil liberties, the User has:

  • the right to rectify their personal data;
  • the right to delete and erase their personal data;
  • the right to object to the use of their personal data;
  • the right to restrict their data; and
  • the right to data portability.

When exercising any of these rights, the User must send MAGNI Ops the information necessary for identification: last name, first name, and/or company name, email address, and possibly postal address. In addition, in accordance with the regulations in force, their request must be signed, accompanied by a photocopy of an identity document bearing their signature, be clear and specify in detail the right they wish to exercise, as well as the address to which they wish to receive the response in the event of exercising one of the rights listed above.

MAGNI Ops then undertakes to respond within a maximum of three (3) months of receiving the User's complete request. Due to the complexity of the request and/or the number of requests, this period may be extended to six (6) months, if MAGNI Ops informs the User within one (1) month of receiving their request of the reasons for the extension.

MAGNI informs Users of their right to lodge a complaint with the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés, hereinafter referred to as the “CNIL”) in one of the following ways:

8. Data retention period

8.1. Data retention following collection

The personal data collected from Users is not retained beyond the time necessary to fulfill the purposes described in this privacy policy, except for data that MAGNI Ops may need to retain as evidence for legal or administrative purposes or in accordance with applicable law.

8.2. Retention of anonymized data beyond the relationship between MAGNI Ops and the User

MAGNI Ops retains Users' personal data collected for the period strictly necessary to achieve the purposes described in this privacy policy. Beyond this period, MAGNI Ops will retain the information provided for three (3) years from the date of collection, including:

  • first and last name or company name;
  • associated mailing addresses;
  • pseudonyms used;
  • associated email addresses or account addresses;
  • telephone numbers;
  • profession and professional sector; and
  • URL addresses of various social media accounts.

Browsing data will be kept for a maximum of six (6) months in accordance with the recommendations of the CNIL (French Data Protection Authority). After this period, it will be anonymized and kept for purely statistical purposes and will not be used in any other way.

8.3. Deletion of data

Measures are in place to purge Users' personal data once the retention or archiving period required to fulfill the specified or imposed purposes has expired.

9. Links

On the Site, Users may have access to various links directing them to third-party sites. MAGNI Ops shall not be liable for any information sent to or collected by these third parties. This privacy policy does not govern third-party websites or third-party content accessed by Users of the Website. MAGNI Ops has no control over hypertext links and/or other promotional formats. Consequently, MAGNI Ops makes no guarantees regarding the personal data protection practices of indexed websites and cannot be held liable in any way in the event of a dispute between a website indexed on the Site and one of the Users, particularly in the event of loss or damage, as the operators of indexed websites are solely responsible for their personal data protection practices.

10. Cookies

A cookie is a text file that may be stored in a dedicated area of the User's computer hard drive when they visit an online service using their browser. In practice, cookies are small text files that are placed on the User's computer by the websites they visit. They are used to make websites work and improve their ease of use. The cookie is transmitted by a website's server to the User's browser. Each cookie is assigned an anonymous identifier. A cookie cannot be traced back to a natural person.

10.1. Purpose of cookies

The cookies used by MAGNI Ops enable the identification of Users, the recognition of their browser when they connect to the Site, the recording of their access frequency (traffic measurement) and their display preferences on the Users' terminal, adapt and/or personalize the presentation of the Site to improve the Users' experience, and optimize the Site for the sole purpose of providing the services requested by the User. In addition, the cookies used on the Site are based on the International Chamber of Commerce guide by category:

  • strictly necessary;
  • functional.

10.1.1. Strictly necessary cookies

Strictly necessary cookies enable the User to browse the Website. These cookies do not collect any information about the User that could be used for marketing purposes. MAGNI Ops uses these cookies to:

  • ensure the Website functions properly;
  • secure forms and protect them from malicious scripts.

MAGNI Ops does not use these cookies to:

  • collect information that could be used to promote services to Users; or
  • remember preferences or Usernames after they have visited the Site.

10.1.2. Functionality cookies

These cookies are used to provide services or to remember the User's settings to improve their visit to the Site. MAGNI Ops does not use cookies to collect personal information that could be used to promote products or services to the User on other sites.

10.2. Cookie retention period

In accordance with the recommendations of the CNIL, the maximum retention period for cookies is thirteen (13) months after they are first placed on the User's device, as is the period of validity of the User's consent to the use of these cookies. The lifetime of cookies is not extended with each visit. The User's consent must therefore be renewed at the end of this period.

10.3. User's right to refuse cookies

When you first visit the Site, a banner explaining the use of cookies appears. It allows you to enable or disable certain cookies. It will only disappear once you have accepted or refused the use of cookies to continue browsing. The storage of a cookie remains subject to the Users' wishes. 11. Transfer of personal data abroad

MAGNI Ops processes User data solely within the European Union and does not transfer this data outside this area. However, in the event of international transfer outside the European Union, a distinction must be made between:

  • countries that have been subject to an adequacy decision by the European Commission: in this case, the Data is transferred to a country that provides a level of protection deemed sufficient and adequate under European data protection regulations; and
  • countries whose level of data protection has not been recognized as adequate: in this case, to ensure that the transfer complies with European regulations, and in particular to ensure data security, MAGNI will base its transfer on protection mechanisms adapted to each service provider and subcontractor, such as the conclusion of standard contractual clauses approved by the European Commission, the application of binding corporate rules, or by virtue of an approved certification mechanism.

12. Security

MAGNI Ops undertakes to implement the appropriate technical and organizational measures reasonably necessary considering the applicable regulations on the protection of personal data, including protection against unauthorized or unlawful processing and against loss, destruction, or accidental damage, to ensure a level of security appropriate to the risks to the rights and freedoms of individuals in the context of the processing referred to in this privacy policy. When personal data is transferred to third parties for processing, MAGNI Ops ensures that these third parties implement all appropriate technical and organizational measures to ensure the protection of personal data in accordance with applicable laws.

These measures are defined considering the state of the art, the costs of implementation, and the nature, scope, context, and purposes of the processing, as well as the risks identified. Depending on the needs, risks, costs, and purpose of the processing, these measures may include pseudonymization and encryption of the data. This protection can be ensured by the “https” in the browser's URL address bar and by the display of a closed padlock at the bottom of the screen. Finally, in the event of a breach of personal data rights that is likely to result in a high risk to the rights and freedoms of the User, MAGNI undertakes to inform the User of this breach within a maximum of seventy-two (72) hours.

13. Changes to the privacy policy

MAGNI Ops reserves the right to modify and update this privacy policy at any time, to consider any legal and/or jurisprudential developments and to meet the requirements of the regulations applicable to the protection of personal data. MAGNI Ops will inform Users of any significant changes or updates to this policy by email.

The prevailing version is the one available online on the day the Site is consulted. Any consultation of the Site after publication of the amended privacy policy constitutes unreserved acceptance of the new privacy policy.
